Terms of Service

You must be at least 18 years old and legally capable of entering into a contract in your jurisdiction. You are responsible for maintaining the security of your credentials and for all activity under your account.

You agree not to use the Service to send unsolicited bulk email (spam), phishing, malware, adult content, gambling promotions, get-rich-quick schemes, or any content that violates applicable law. You will maintain a bounce rate below 5% and a complaint rate below 0.3%.

We may suspend accounts that violate the Acceptable Use Policy without prior notice, and delete content that violates law or third party rights.

You represent that every recipient on your lists has provided lawful consent to receive the type of message you intend to send. You will honour unsubscribe requests within 24 hours (and immediately when our platform records them).

The Service uses a prepaid credit wallet model. Credits are purchased in INR through Razorpay in advance (1 credit = ₹1 unless otherwise noted in your dashboard). Every message deducts credits at the rate displayed at time of sending. All fees are exclusive of taxes. You are responsible for GST, VAT or other applicable taxes.

Enterprise customers on annual contracts are billed per the mutually signed Order Form.

Unused credits are refundable within 30 days of purchase minus a 5% processing fee. See our Refund Policy for details.

You are responsible for maintaining your own accounts with email providers (AWS SES, SendGrid, Mailgun, SMTP, Meta WhatsApp) and for fees payable to those providers. Notifyr orchestrates delivery only.

The Service, including all software, designs and content owned by us is our exclusive property. Nothing in these Terms transfers intellectual property rights to you. Your content remains yours; you grant us a limited licence to process it solely to provide the Service.

Each party will protect the other's confidential information with the same care it uses for its own confidential information, and at least reasonable care.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN A SIGNED AGREEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Notifyr'S TOTAL LIABILITY WILL NOT EXCEED THE FEES PAID BY YOU TO Notifyr IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES.

You will indemnify and hold Notifyr harmless from claims arising out of your content, your violation of these Terms, your violation of law or your infringement of a third party's rights.

These Terms remain effective while you use the Service. Either party may terminate at any time. Upon termination, you may export your data for 30 days; after that, we delete it in accordance with our Privacy Policy.

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. The courts of Bengaluru, Karnataka shall have exclusive jurisdiction.

We may update these Terms occasionally. Material changes are announced at least 30 days in advance by email. Continued use of the Service after changes take effect constitutes acceptance.
